Estate distribution agreement in Norway

An estate distribution agreement records what the parties have agreed about division. For a deceased estate, it can document who receives particular assets and the settlement agreed between the parties. It differs from a skifteattest, which establishes authority to handle the estate.

The County Governor of Vestfold and Telemark lists a signed distribution agreement as an example of evidence that division has been completed. In that context, documentation should show the allocation of assets, debts and any compensation. This does not mean every agreement resolves all legal issues.

Identify the actual objects

Practical example: heirs wish to distribute inherited tableware and sell a coin collection. Use an object inventory with photographs so the agreement clearly identifies the items. Record what will be retained, the valuation basis used and what is actually offered for sale.

An OBA purchase offer concerns a possible sale and does not determine inheritance shares. Disputes, guardianship, wills or uncertain debt liability call for legal assessment before objects are handed over.

Different documents serve different purposes

The Tax Administration's “Erklæring om skifte”, used when checking eligibility to marry, is a separate form. It is not the parties' distribution agreement. This overview concerns Norway, checked on 1 November 2026.

Once distribution and authority to sell are clear, request an OBA inspection and offer for the contents.
